EverHale, by Elbo International Pty Ltd (ABN 47 633 344 215), AustraliaLast updated: 3rd September, 20261. AgreementBy downloading or using EverHale, you agree to these terms. If you do not agree, please do not use the app.EverHale is published by Elbo International Pty Ltd, an Australian company.2. What EverHale is — and is notEverHale is a health journal. It records what you tell it, keeps that record on your device, and summarises your own history back to you.EverHale is not medical advice, and is not a medical device. It does not diagnose, predict, treat, prevent or manage any condition. It does not tell you what is wrong with you, what to do about it, or when to take anything.Specifically, EverHale will never:suggest a diagnosis or what your symptoms mean;
predict what will happen to your health;
recommend, calculate or time a medication dose;
tell you a pattern is a cause.
Patterns shown in the app are observations over your own entries, with a count of how many times they were seen. They are things you said, counted back to you. They are not findings, and they are not conclusions.Always consult a qualified health professional about your health. Never delay seeking medical advice, or disregard advice you have been given, because of something in EverHale. If you think you have a medical emergency, call your local emergency number immediately.3. Your record is yoursYou own what you put into EverHale. We claim no rights over your entries, recordings, photos or notes.Because there is no EverHale server, we hold no copy of your record and cannot retrieve, restore, inspect or delete it for you. Your data lives on your device and in your own iCloud. Keeping it safe — your device passcode, your Apple account security, your backups — is in your hands.You can export your complete record at any time, in any subscription state.4. Subscriptions and paymentEverHale is a paid subscription. One price includes everything: all features, family profiles, no locked extras and no premium tier.Free trial: 30 days.
Prices: A$4.99 per month, or A$39.99 per year (Australian pricing; other regions are priced by Apple in local currency).
Billing: handled entirely by Apple through your App Store account. We never see or hold your payment details.
Renewal: subscriptions renew automatically unless cancelled at least 24 hours before the period ends. Your account is charged for renewal within 24 hours of the period ending.
Cancelling: manage or cancel in iPhone Settings → your name → Subscriptions. Cancelling stops future charges; it does not refund the current period.
Free trial and cancellation: if you cancel during the trial, you are not charged. Any unused part of a free trial is forfeited if you subscribe during the trial period.
Refunds: all refunds are handled by Apple under the App Store terms. We cannot issue refunds directly.
Sponsored year. If you cannot afford EverHale, you may write to us and ask for a sponsored year. We grant these individually and at our discretion, as an App Store offer code redeemed through Apple. It is not a free tier and not a right; there is nothing to unlock and no code to buy.5. If your subscription lapsesYou never lose access to your own record. If your subscription ends, you can still open EverHale, read everything you have ever logged, and export all of it. Only adding new entries requires an active subscription.6. Device requirementsEverHale requires iPhone 15 Pro or newer, because the AI runs on your device and needs Apple's on-device model support. Some features require iOS features, permissions or Apple services that you choose to enable. We cannot guarantee EverHale will work on unsupported hardware or on modified devices.7. How you may use EverHaleUse EverHale for your own health record, or for someone whose journal you keep with their agreement.You must not:keep a journal for another adult without their consent;
use EverHale to provide clinical services to others, or as a system of record for a clinic or practice;
attempt to reverse-engineer, decompile or interfere with the app;
use EverHale in any way that breaks the law where you are.
8. Availability and changes
We may update EverHale, add features, or change how features work. We may discontinue the app, though we would give notice and your export would remain available first. We do not guarantee uninterrupted availability, and Apple services EverHale relies on (iCloud, Health, Weather, Siri, the App Store) are outside our control.9. LiabilityTo the maximum extent permitted by law, EverHale is provided "as is". We do not warrant that it will be error-free, that the AI will interpret everything you say correctly, or that it will meet any particular purpose. You are asked to check every entry before it is saved for exactly this reason.We are not liable for any loss arising from your use of EverHale, including any health decision you or anyone else makes based on what the app shows, or from data loss on your device or in your iCloud.Australian consumers: nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Where our liability cannot be excluded, it is limited to resupplying the app or paying the cost of resupply, at our option.10. Ending your useYou may stop using EverHale at any time by cancelling your subscription and deleting the app. We may end your access if you breach these terms.11. Changes to these termsIf these terms change, the updated version appears here and in the app, with a new date at the top. Continuing to use EverHale after a change means you accept it.12. Governing lawThese terms are governed by the laws of Victoria, Australia. Disputes are subject to the courts of Victoria, without limiting any right you have to bring a claim in your own jurisdiction where the law gives you that right.13.
